SiteVerity Terms of Service

Effective Date: September 2026 | Latinconnect IT Solutions LLC

These Terms of Service ("Terms") constitute a legally binding agreement between your construction business, entity, or representative ("Licensee", "Customer", or "You") and Latinconnect IT Solutions LLC ("SiteVerity", "Company", "We", or "Us"). By accessing, subscribing to, or using the SiteVerity software-as-a-service platform, mobile applications, APIs, and documentation, you agree to be bound by these Terms.

1. SaaS Subscription & 14-Day Trial

SiteVerity grants you a non-exclusive, non-transferable, revocable license to access and use our unified construction management CRM and compliance engine during the subscription period.

  • 14-Day Free Trial: Eligible new customers receive 14 calendar days of full access to platform features without requiring a credit card at signup. Upon expiration of the 14-day trial period, continuing access requires selection and payment of an active SaaS subscription tier via Stripe.
  • Plan Limits: Use of the platform is subject to the numerical worker caps, project thresholds, and company seat limits established in your selected subscription tier (e.g., Essential Hero, Professional Pro, Enterprise Vanguard).
  • Cancellations: Subscriptions can be managed or canceled at any time through the customer billing portal before the next recurring billing cycle.

2. NYC DOB Bulletin BB 2024-007 Compliance & Statutory Disclaimer

SiteVerity is engineered to satisfy the technical standards established in NYC Department of Buildings (DOB) Bulletin BB 2024-007 for digital record-keeping systems.

Important Legal Disclaimer: The NYC Department of Buildings does not license, certify, or endorse commercial software applications. The availability of digital record-keeping features within SiteVerity does not relieve the Licensee, General Contractor, Construction Superintendent, Site Safety Manager (SSM), Site Safety Coordinator (SSC), or Competent Person of their statutory duties under the New York City Construction Codes, OSHA regulations, or Local Law 196.

Contractor Sole Accountability: Licensee agrees that it is solely and exclusively responsible for:

  • The factual accuracy, authenticity, completeness, and truthfulness of all entries, logs, hours, photos, and records submitted through the system.
  • Independently verifying that all on-site personnel hold genuine, unexpired safety cards (SST, OSHA 30, Rigging) prior to commencing hazardous work.
  • Executing timely physical inspections of suspended scaffolds, supported scaffolds, sidewalk sheds, and job site safety perimeters.
  • Any violations, Environmental Control Board (ECB) summonses, stop-work orders, penalties, or fines levied by municipal or federal authorities.

SiteVerity provides deterministic digital recording tools and technical support, but does not provide legal, architectural, or professional engineering counsel.

3. Worker Authentication & Biometric Information

SiteVerity incorporates worker profile verification features, including photo identification, PIN matching, and SST badge tracking.

  • Consent & Lawful Collection: Licensee represents and warrants that it has complied with all applicable New York City, New York State, and federal labor laws, including providing any required notices and obtaining lawful employee/subcontractor consent prior to uploading photographs, biometric profiles, or personal data to SiteVerity.
  • Authorized Access: Licensee agrees to safeguard user credentials and supervisor PINs. Any digital record sealed with a supervisor's PIN is deemed executed by that authorized individual under NYS ESRA.

4. Electronic Signatures (NYS ESRA) & Cryptographic Audit Trails

SiteVerity applies SHA-256 cryptographic hashes and timestamped audit logs to safety records, daily logs, and scaffold inspection forms in accordance with the New York State Electronic Signatures and Records Act (State Technology Law §§ 301–309).

Licensee acknowledges and agrees that electronic signatures generated through the platform carry the same legal validity, evidentiary admissibility, and enforceability as handwritten ink signatures.

5. 6-Year Retention & Data Ownership

Data Ownership: Licensee retains sole and exclusive proprietary ownership of all job site data, worker logs, project production metrics, and uploaded credentials.

Archival Policy: SiteVerity automatically archives completed and signed compliance records for a minimum duration of six (6) years to assist Licensee in fulfilling NYC Building Code audit mandates, provided Licensee maintains an active subscription or requests data export prior to account termination.

6. Limitation of Liability & Warranty Disclaimer

SiteVerity is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted under applicable law:

  • Latinconnect IT Solutions LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular construction project, or error-free continuous operation.
  • In no event shall Latinconnect IT Solutions LLC, its members, directors, employees, or affiliates be liable for any indirect, consequential, punitive, or municipal fine-related damages arising from job site incidents, worker non-compliance, or system interruptions.
  • Our aggregate liability for any claims related to the platform shall not exceed the total subscription fees paid by Licensee to SiteVerity during the twelve (12) months immediately preceding the event giving rise to liability.

7. Governing Law & Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of New York, without regard to its conflicts of law principles. Any legal proceeding arising out of these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
